TERMS & CONDITIONS (STANDOUT MARKETING)

Standout Marketing Terms & Conditions
Last updated: 12 October 2026

Welcome to Standout Marketing.
These Terms & Conditions ("Terms") apply to the services provided by Standout Marketing ("Standout Marketing", "we", "us" or "our").
By engaging our services, placing an order or accepting a quotation from us, you confirm that you have read, understood and agreed to these Terms.
These Terms are intended to protect both Standout Marketing and our clients and to ensure a clear and straightforward working relationship.

1. Services We Provide
Standout Marketing provides creative, digital and printed marketing services for businesses.
Our services may include:
  • Digital menu design.
  • Digital menu hosting and management.
  • Digital signage and remote management services.
  • Android media sticks used to operate digital menus.
  • Printed menus and other printed marketing materials.
  • Leaflets and flyers.
  • Posters.
  • Loyalty cards.
  • Business cards.
  • Pavement signs and other promotional materials.
  • Social media content and related marketing services.
  • Other design or marketing services agreed between Standout Marketing and the client.
The exact services provided will be those agreed in the relevant quotation, invoice, order or other written communication.

Digital Display Services
Where digital menus or digital signage services are provided through Standout Display, those services are subject to the separate Standout Display Terms & Conditions.
These general Standout Marketing Terms continue to apply to any other services purchased from us.

2. Screens and Display Hardware
Standout Marketing does not supply, install, maintain or manage television screens, monitors or other display screens unless specifically agreed in writing.

Where an Android media stick or other compatible device is purchased from Standout Marketing, the device is sold outright to the client.

Once payment has been received and the device has been delivered, ownership passes to the client.
The client does not need to return the device if they later cancel or stop using our digital menu or remote management services.

We are not responsible for faults, damage or problems relating to:
  • Television or monitor hardware.
  • Screens or displays.
  • Power supplies.
  • Internet connections.
  • Wi-Fi networks.
  • Routers.
  • Third-party hardware.
  • Hardware incompatibility.
  • Hardware used incorrectly or modified by the client.
  •
Any manufacturer warranty applicable to supplied hardware will be subject to the manufacturer's own terms.

3. Third-Party Software and Services
Some of our services rely on third-party software, platforms, hosting providers, suppliers or technology services.

We will take reasonable steps to assist with issues affecting services we provide, but we cannot guarantee the availability, performance or functionality of third-party services.
We are not responsible for outages, bugs, errors, technical failures or changes introduced by third-party platforms.

Where a third-party service is required for a service we provide, the client acknowledges that continued use of that service may be subject to the third party's own terms and availability.

4. Quotes and Orders
Quotes provided by Standout Marketing are based on the information available to us at the time of quoting.

Unless otherwise stated, a quotation is valid for the period stated on the quotation.
Changes to the requested work after a quotation has been accepted may result in additional charges.
We will aim to notify the client of any significant additional costs before carrying out additional work.
An order becomes binding once the client has accepted the quotation, paid a required deposit or otherwise confirmed that they wish us to proceed.

5. Payments
Payment terms will be stated on the relevant quotation or invoice.
Unless otherwise agreed:
  • A 50% deposit is required before design work begins.
  • The remaining 50% balance is due upon completion of the agreed design work.
  • Full payment may be required in advance for certain products or services, including printed media and physical products.
  • Ongoing services such as remote management are payable in accordance with the applicable renewal terms.
Payments should be made using the bank details provided on the current invoice.
If payment is accidentally made to an old or incorrect bank account, the payment may need to be returned before payment can be made to the correct account.
The client remains responsible for ensuring that invoices are paid correctly and on time.

6. Refunds and Cancellations
Because many of our services involve bespoke design or customised products, cancellation and refund rights may vary depending on the stage of the work.
Where design work has already begun following payment of a deposit, the deposit may be non-refundable to the extent permitted by law, as work has already been carried out.
Where a client cancels a project after work has begun, we may charge for work already completed.
Deposits are valid for 3 months from the date of payment. If a client fails to respond or provide the information needed to progress their project within this period, Standout Marketing reserves the right to close the project after three unsuccessful attempts to contact them.
If a client wishes to restart a project after it has been closed or the 3-month validity period has expired, additional charges may apply. Any work already completed, costs incurred and applicable refund terms will be taken into account. Restarting a project is not guaranteed and may require a new quote.
For custom printed products, cancellation or refunds may not be available once the client has approved the final design and production has begun, subject to any rights that cannot legally be excluded.
Ongoing service fees, including remote management fees, are subject to the cancellation and refund terms applicable to that service.

7. Client Communication and Required Information
Clients are responsible for providing the information and materials reasonably required for us to complete their work.
This may include:
  • Business names.
  • Logos.
  • Brand colours.
  • Fonts.
  • Images.
  • Product information.
  • Prices.
  • Contact details.
  • Menus.
  • Promotional information.
  • Design preferences or guidelines.
Delays in providing information, approving designs or responding to queries may affect the estimated completion date.
We are not responsible for delays caused by the client failing to provide required information or approvals within a reasonable timeframe.

8. Design Revisions and Approvals
The number of design revisions included in a service will depend on the quotation or package agreed with the client.
Where a specific number of revisions is included, additional revisions may be charged separately.
Clients are responsible for carefully checking designs before giving final approval.
This includes checking:
  • Spelling.
  • Prices.
  • Product descriptions.
  • Images.
  • Offers.
  • Contact information.
  • Business details.
  • Layout.
  • Colours.
  • Other supplied content.
Once a design has received final approval, we will consider the design work complete.
Changes requested after final approval may incur an additional charge.

9. Digital Menu Updates
Where digital menu updates are included within a client's service, the number and type of included changes will depend on the package purchased.

For remote-managed digital menu clients, the applicable allowance for menu edits will be stated in the client's service agreement, quotation or invoice.

Additional changes outside the included allowance may be subject to an additional charge.
We reserve the right to charge for substantial redesigns or changes that go beyond minor menu updates.

10. Remote Management Services
Where a client purchases remote management, the service allows Standout Marketing to assist with managing digital menu content, playlists and related digital display services.
The exact services included will depend on the package purchased.
Remote management may include:
  • Menu updates.
  • Price changes.
  • Playlist changes.
  • Promotional content updates.
  • Scheduling.
  • Digital menu management.
  • Technical assistance relating to the supported service.
Remote management does not include the supply, installation or repair of television screens or monitors unless specifically agreed.
Where the client's digital display service relies on third-party hardware, internet connectivity or third-party software, issues caused by those services may fall outside the scope of remote management.

11. Remote Management Renewal and Late Payment
Remote management renewal fees must be paid by the applicable renewal date.
A delay of more than 14 days in payment of a remote management renewal may result in interruption of the remote management service.
If payment remains unpaid for more than 28 days, the applicable service or account may be suspended and may subsequently be deleted in accordance with the applicable service Terms & Conditions.
Businesses that repeatedly pay late may be required to pay for future services in advance.

12. Printed Media
Standout Marketing provides a range of printed marketing materials, including menus, leaflets, posters, loyalty cards, business cards and other promotional products.

Design Approval
All printed designs must be approved by the client before production.
Once approval has been provided, the client is responsible for checking the final design, including spelling, pricing, layout, colours and content.
Standout Marketing is not responsible for errors that were present in an approved design.
Changes requested after approval may incur an additional charge.

Printing and Production
Printed products may be produced through third-party printing and fulfilment suppliers.
We will use reasonable care when arranging printed products but cannot be held responsible for delays, production issues, courier delays or other problems caused by third-party suppliers or delivery providers.
Delivery dates are estimates and may vary depending on production and courier services.

Colour
Colours may appear differently between screens, digital proofs and printed products due to differences in monitors, devices, printing processes and materials.
Exact colour matching cannot be guaranteed unless a specific colour-matching service has been agreed in advance.

Client-Supplied Content
Clients are responsible for providing suitable, high-quality images, logos and other content.
We are not responsible for reduced print quality resulting from low-resolution, unsuitable or poor-quality files supplied by the client.

Cancellation and Refunds
Due to the customised nature of printed products, cancellation or refunds may not be available once the final design has been approved and production has begun, subject to any rights that cannot legally be excluded.

13. Third-Party Suppliers
We may use third-party suppliers and fulfilment partners to produce or deliver products and services.
We remain responsible for coordinating the service we have agreed to provide, but we cannot guarantee the performance, availability or delivery times of third-party suppliers.
Where a delay, fault or error is caused by a third-party supplier or courier, we will reasonably assist in resolving the issue but cannot guarantee a particular outcome or delivery date.

14. Intellectual Property
Unless otherwise agreed in writing, Standout Marketing retains ownership of its underlying templates, processes, systems, software, branding, working files and other materials used to provide our services.
For bespoke final designs, ownership or permitted use will be determined by the agreement or quotation relating to that work.
Where full payment has been received and the relevant quotation states that the client receives ownership of the final design, the client will receive the agreed rights to that final design.
Third-party fonts, images, graphics, software or other assets may remain subject to their own licensing terms.
Client-supplied content remains the property of the client or its relevant owner.

15. Portfolio and Marketing Use
Unless a client requests otherwise in writing, Standout Marketing may showcase completed work that we have created for the client in our portfolio, website, social media or other marketing materials.
We will not knowingly disclose confidential business information solely for portfolio purposes.
Clients who do not wish their completed work to be used for promotional purposes can request this in writing.

16. Client Content and Legal Responsibility
The client is responsible for ensuring that any content supplied to Standout Marketing can legally be used.
This includes ensuring they have the necessary rights or permissions for:
  • Images.
  • Logos.
  • Videos.
  • Music.
  • Fonts.
  • Written content.
  • Product information.
  • Promotional claims.
  • Other intellectual property.
The client is also responsible for ensuring that their menus, advertising and promotional materials comply with applicable laws and regulations.
Standout Marketing is not responsible for legal claims arising from content supplied or approved by the client.

17. Client Information and Privacy
We collect and process personal information as necessary to provide our services, communicate with clients, process orders and manage our business relationship.

18. Confidentiality
We will take reasonable steps to keep confidential business information provided to us confidential, except where disclosure is necessary to provide the agreed service, required by law or necessary to protect our legitimate business interests.
Clients should not provide passwords or other sensitive information unless it is genuinely required for the service.

19. Our Responsibility
We will provide our services with reasonable care and skill.
However, we do not guarantee that:
  • Designs will meet a client's subjective expectations where the agreed brief has been followed.
  • Third-party software or suppliers will always be available.
  • Digital displays will operate continuously without interruption.
  • Printed products will arrive on a particular date where delivery is controlled by a third party.
  • Client-supplied information or content will be error-free.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

20. Limitation of Liability
To the extent permitted by law, Standout Marketing will not be responsible for losses caused by circumstances outside our reasonable control, including:
  • Third-party software failures.
  • Hosting outages.
  • Internet failures.
  • Hardware failures.
  • Courier or supplier delays.
  • Incorrect information supplied or approved by the client.
  • Unauthorised use of a client's account.
  • Events outside our reasonable control.
We will not be liable for indirect or consequential losses where such liability can lawfully be excluded.
Nothing in these Terms limits liability for matters that cannot legally be limited or excluded.

21. Termination and Refusal of Service
Standout Marketing reserves the right to refuse or discontinue services where reasonably necessary.
This may include circumstances involving:
  • Abusive or inappropriate behaviour towards us.
  • Unreasonable or excessive demands outside the agreed scope of work.
  • Repeated failure to provide required information or approvals.

  • Misuse of our services.
  • Illegal or inappropriate content.

Where appropriate, we will provide reasonable notice before discontinuing an ongoing service.

We may change, update or discontinue individual services, products or pricing from time to time.
Where a client has an active ongoing service, we will provide reasonable notice of material changes where appropriate.
